We will treat each order for goods or payment for goods as an agreement by you to purchase the goods subject to these terms and conditions. This does not affect your statutory rights.
Purchasing and reserving
If you would like us to reserve an item we will take a non-fundable deposit of 50% and hold the item for a fixed period of time as agreed.
All items remain our property until paid for in full.
Our standard delivery service is ideal for most of the items offered for sale on our website. All deliveries will require a signature unless otherwise agreed at the time of purchase. Deliveries will be made by Royal Mail, Parcel Force, or Fragilisitcs dependent on the items order. In certain circumstances we may choose to make the delivery to you ourselves.
In the case of highly valuable or fragile items we recommend our specialist art courier service to ensure safe receipt of your purchase and peace of mind. This is a fantastic service carried out by experts in the delivery of fragile and precious items. Please contact the gallery if you wish to know more about this service.
Acceptance of delivery
Unless agreed at the time of purchase your item will be sent to you via a service that requires a signature on receipt. It is important that you examine your parcel carefully before signing for it. You don’t have to unwrap the item(s) but if there are any external signs of damage to the packaging such as holes, dents, bending, or signs of damp then make a note with your signature so that this is recorded by the delivery company. If you do not make a note of any external damage you will be considered to have signed for your delivery in perfect condition.
Return of items purchased in the gallery
We do not accept the return of items purchased in the gallery or offer any refunds. However, we reserve the right to offier you a credit note or an exchange at our discretion.
Return of items purchased via our website
We are on hand to help you with your purchase and ask you consider your purchase carefully to make sure you are making the right choice.
If you wish to return your purchase you must advise us in writing (by email to firstname.lastname@example.org) within 7 days of receipt of your order. You must do this before you return your item to us. After 7 days no retruns will be accepted.
Returns must be made in all of the original packaging and returned to us at your own cost. You will be responsible for any loss or damage to any item you return to us. We strongly advise you consult us before making a return so that we can advise on appropriate couriers and insurance. Items returned must be received by us in a fully re-saleable as-new condition. On receipt of a return we will check the item for any damage and if all is ok we will issue a refund. Refunds will be processed within 30 days from the point of return and will be subject to a 10% administration charge. If an item is returned to us damaged in any way whatsoever we will not refund any monies. If you wish to recieve the item back you will be liable for all delivery costs.
Cancellation of purchases on-line or by phone
If you are making a purchase as a consumer and your order is not taken at our business premesis you may cancel your contract to purchase the goods within 14 days, beginning on the day you paid for the goods. Bespoke items made or commissioned for you are exempt from this cancellation policy and no refunds will be given. To cancel a contract you must advise us in writing that you wish to cancel the contract. You can do this by email or post. If you cancel your contract within 14 days of the purchase we will refund you the price paid for the goods. However we are permitted by law to reduce you refund to reflect any reduction in the value of the goods if this reduction has been caused by you handling them in a way that would not be permitted at one of our retail outlets.
We do not offer any refunds on items purchased in store. This does not affect your consumer rights. Exchanges and credit notes may be given at our discretion.
Bespoke items and commissions
We cannot offer any refunds or accept return of any item commissioned by you or specifically customised to your requirements (this includes when we have framed an item for you).
We may receive your personal data in the course of you making an enquiry with us or completing a purchase from us. We will use your data for the purposes of processing your purchase and/or responding to your enquiry. We may from time to time inform you of news/events/offers etc at Fizz Gallery. If you do not wish to receive such information please inform us in writing. (email email@example.com). We will never pass your details to anyone else.
Using our website and social media
Items for sale on our website are displayed with approximate sizes. Please read the product descriptions carefully to confirm if the size shown includes framing or not (where relevant). If you wish to verify exact sizes please ask us.
We take great care to ensure in as far as is possible, that the images displayed represent the item for sale. However colours may vary slightly and we cannot control how your equipment reproduces the colours you see on your screen or device.
All copyright and ittlectual property for any artworks remain with the artist who created them. Reproduction is not permitted under copyright law.
